Abstract:
Traditionally, human rights protection has been linked to the role of the State from two different perspectives, namely, the State respecting the rights of its population, and the State protecting its population from the violation of human rights by other social actors. These duties are generally accepted and pursued by governments in relation to the protection of individuals’ human rights from the State actions as well as the guarantee of certain economic, social, and cultural rights. However, the effective protection of human rights needs other non-state agents' actions, which are not explicitly supervised by human rights’ international agencies or civil organizations which tend to focus on cases of the State’s violations. These non-state actors –going from international enterprises to individuals, churches, local communities and other social groups– are sometimes the main obstacle for the implementation of a human rights regime. There is not a clear international policy with respect to how these non-state actors should account for their participation in the promotion or violation of human rights. If it is emphasized that human rights constitute a minimum ethical paradigm, every social actor –not only the states– will be obliged to protect them, although this can lead to significant contradictions regarding traditions and habits of specific cultures, such as the case of dalit population and Chinese preference for sons.
